On December 11, 2025, President Trump signed an Executive Order titled 'Ensuring a National Policy Framework for Artificial Intelligence' to consolidate AI oversight at the federal level and counter the expanding patchwork of state AI rules. The EO uses litigation, spending, and standard-setting levers to discourage states from regulating AI, while targeting state regulatory action in areas such as algorithmic transparency, bias mitigation, and high-risk AI uses. However, the EO maintains that federal efforts will not preempt state authority in areas such as child safety, AI infrastructure, and governmental AI procurement. The EO does not preempt current state AI laws and further federal action is required.
